In execution of the Deed of Trust dated December 13, 2012 and recorded on December 28, 2012 in Instrument # 120004780 of Mecklenburg County land records, Trustee Services of Virginia, LLC, the appointed Substitute Trustee, will offer for sale at public auction at the front of the Circuit Court for the County of Mecklenburg, 393 Washington Street, Boydton, Virginia on July 31, 2019 at 2:00 PM the property more particularly described in the aforementioned Deed of Trust, located at the property address listed below and briefly identified as follows: 

Parcel 1: All that certain lot or parcel of land situated in Clarksville Magisterial District of Mecklenburg County, Virginia, containing 0.45 acre, adjoining the John H. Kerr Reservoir property, and more particularly described according to a plat of survey prepared by Alfred H. Carter and attached to a deed dated July 28, 1966, being made a part of the same by reference thereto, said lot of land being located about four miles Southeast of the Town of Clarksville, Virginia, and more particularly described according to said plat as follows:

Beginning at an iron on the 320 foot contour line of the U.S. Government John H. Kerr Reservoir property, as shown on the plat, thence off the contour line N. 44 deg. 00' E. 181.43 feet to an iron; thence S. 38 deg. 30' E. 100.86 feet to an iron; thence S. 44 deg. 00' W. 178.67 feet to an iron on the aforementioned 320 foot contour line of the Reservoir; thence in a Northerly direction along said 320 foot contour line 125 feet, more or less, to the iron which is the point of beginning.

  Parcel 2: A strip of land 25 feet wide, contiguous to the above described real estate, fronting on Buggs Island Reservoir and described as beginning at a pipe on the 320 foot contour line of Buggs Island Reservoir property as shown upon a certain plat prepared for Donald L. Maddox and Edna F. Maddox, by J. Walter Jones, Jr., C.L.S., which said plat is attached to a certain deed dated July 12, 1961, from Meriweather Lewis, et ux. to Donald L. Maddox, et ux., which said deed is recorded in the Clerk's Office of the Circuit Court of Mecklenburg County, Virginia, in Deed Book 178, Page 465, and thence running N. 44 deg. 00' 00" E. 178.71 feet to a pipe, which line is contiguous to the above described real estate; thence S. 54 deg. 04' 30" E. 25 feet to a point; thence along a line and parallel to the first above described line; thence along the said 320 foot contour line to the pipe and point of beginning.

   Parcel 3: All that certain lot or parcel of land situated in Clarksville Maglsterial District of Mecklenburg County, Virginia, located on Buggs Island Lake, and being more particularly described as follows:

Beginning for the same at an iron pipe found at the Southwesterly corner of the Edna F. Maddox (now Twiddy) 0.45 acre tract at the 320 foot contour of Buggs Island Lake; thence running with and along the 320 foot contour line in a Westerly direction 88.0 feet, more or less, to a point in the division line between Parcel I and Parcel J of Merifield Acres; thence leaving the 320 foot contour and running with and along the division line N. 62 deg. 24' 55" E. 250.0 feet, more or less, to the Southerly right of way line of Merifield Drive (a forty foot wide right of way); thence running with and along same in a Southeasterly direction a distance of 160.0 feet, more or less; thence leaving the Southerly right of way line of Merifield Drive and running S. 44 deg. 00' 00" W. 20.0 feet, more or less, to the Northeasterly corner of the Edna F. Maddox Twiddy property aforementioned; thence running with and along the land of Edna F. Maddox Twiddy the following three courses and distances: (1) N. 54 deg. 04' 30" W. 25.25 feet to an iron pipe found, thence (2) N. 38 deg. 30' 00" W. 100.86 feet to an iron pipe found, thence (3} S. 44 deg. 00' 00" W. 181.43 feet to the point of beginning, containing 0.41 acre of land according to survey by Thomas R. Koval, Certified Land Surveyor, dated March 27, 1973, plat of which is recorded in the Mecklenburg County, Virginia, Clerk's Office.

The property will be sold "AS IS," WITHOUT REPRESENTATION OR WARRANTY OF ANY KIND AND SUBJECT TO conditions, covenants, restrictions, reservations, easements, rights of way, and all other matters of record taking priority over the Deed of Trust, if any, as might be listed in this notice or may be announced at the sale. 

TERMS OF SALE:  A non-refundable bidder's deposit of $29,500.00 or 10% of the sale price, whichever is less, by cashier's or certified check required at time of sale, except for the party secured by the Deed of Trust. Risk of loss is on the purchaser from date and time of auction. Balance of the purchase price must be paid by cashier's check within 14 days from sale date. Except for Virginia Grantor tax, all settlement costs and expenses are purchaser's responsibility.  Taxes are pro-rated to the date of sale.  Purchaser is responsible for obtaining possession of the property.  If purchaser defaults, deposit may be forfeited and property resold at the risk and cost of the defaulting purchaser who shall be liable for any deficiency in the purchase price and all costs, expenses, and attorney’s fees of both sales.  If Trustee does not convey title for any reason, purchaser's sole remedy is return of deposit without interest. This sale is subject to post-sale audit of the status of the loan secured by the Deed of Trust including but not limited to determining whether prior to sale a forbearance, repayment, or other agreement was entered into, the loan was reinstated or paid off, or whether the property became subject to an automatic stay under the U.S. Bankruptcy Code prior to the sale; in any such event this sale shall be null and void and purchaser’s sole remedy shall be return of deposit without interest.  Pursuant to the Federal Fair Debt Collections Practices Act, this law firm is a debt collector attempting to collect a debt and any information obtained will be used for that purpose.
